Gnomo OE offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. Don't worry! We can assure you there are no hidden tricks and you're not unawaredly selling us your soul, but you can have a look if you please. All the products you see at https://gnomo.eu/ are sold directly by Gnomo OE, a Spanish firm located in 32 Cuba St., Valencia. Besides selling our products in our brick and mortar shop, we sell online to Spain and the rest of the world under certain conditions. Our store is hosted on Shopify Inc. ("Shopify"). Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you. SECTION 1 - BUYING PRODUCTS In Gnomo you can find information about all the products on sale and how to buy them. As a user of www.gnomo.eu you agree to provide current, complete and accurate purchase and account information for all purchases made at our store.
SECTION 2 - PAYMENT METHODS Once you have your products in your cart and your register is completed, you will have several options for the payment. You can choose make the payment by card, bank transfer, Paypal or Bizzum.
Card. You can pay using your credit or debit card Visa, Mastercard or American Express. If you choose this method, you just have to complete the required information with your card data and your payment will be completed throught a Shopify secure payment platform. All transactions are encrypted and we don't have access to your credit card information at any time.
Bank transfer. You can pay by making a bank transfer or a bank deposit to the following bank account:

Sometimes, banks take their time in processing bank transfers and we may not see your payment until a couple of days later. If you want to speed things up just send us a payment slip to email@example.com.
Paypal. You will be redirected by Shopify in order to pay with your account through the secure payment platform Paypal. This payment method does not require you to sign up or share your card details.
Bizzum. This payment method does not require you to sign up or share your card details, either. Simply, make the payment for the total amount of your purchase once you complete it into the thelephone number 658 57 3131 (Esther M. A.)
In either case, your order will be processed after we receive the payment. You will receive an email once everything is settled.
Orders and order information will be hold in Gnomo's database for the time stipulated by the Spanish law. You can access your data and your order history at any time through by signing into your account at gnomo.eu.
SECTION 3 - PRODUCTS, PRICES AND SHIPPING
Gnomo reserves the right to decide at any time the products that will be offered through gnomo.eu, being able to add or remove products from its online store. Likewise, the prices of the products may also be modified without prior notice. However, if you have just made a purchase and the price suddenly changes, do not worry: the modifications will in no case be applied to sales already formalized.
The characteristics of the products are presented in detail at gnomo.eu within each product file. Despite this, it may happen that the images and / or colors of the products displayed do not accurately reflect reality due to the specific characteristics of the internet browser or the screen or device used by the user.
The prices of the products for sale on gnomo.eu always appear in euros (€) and include the corresponding taxes. The relevant shipping costs will be added to these prices. The shipping rates will be communicated to you before placing the order, and as a user you must expressly accept them when confirming the purchase.
Home shipments have a different cost depending on the country of destination, and the weight (or volumetric weight) of the products purchased. The total price of shipping costs will be indicated on the purchase summary page.
The shipping rates may vary, depending on the promotions that Gnomo decides to apply at a certain time or the changes in the rates given by the transport companies.
The delivery date to the address you indicate depends on the availability of the chosen product and the shipping area. For shipments within Spanish territory, the approximate delivery time is one to three days. We will provide you with the shipping number provided by the transport company that makes the delivery, so that you can track the order from their website. We are not responsible, of course, for delays caused by force majeure. We can't control all truckers' strikes, floods, and windstorms (yet).
At Gnomo we try to have all the products displayed in the virtual store available. Still, demand sometimes exceeds expectations or the manufacturer experiences an unexpected delay. If any requested item is not in stock at that time, we will indicate that delivery may be delayed and we will always give you the option to change or cancel your order.
Gnomo undertakes to deliver the products in perfect condition to the address that you have indicated as a user in the order form. We recommend that you indicate an address where the order can be delivered within normal business hours. As we told you before, Gnomo will not be responsible for errors caused in the delivery when the shipping address that you have indicated in the order form does not conform to reality or has been omitted.
Upon receipt of the order, you must check the status of the package with the transport company that delivers it on behalf of Gnomo, and you must reflect on the delivery note any anomaly that you could detect in the packaging. If once the product has been reviewed, you detect any incident such as damage, breakage or similar caused by the shipment, you must notify us by email to firstname.lastname@example.org in the shortest possible time (maximum 7 working days), in order to process the return.
Gnomo ships to many countries. The price of the orders does not include customs expenses, duties, as well as other taxes that the destination country may consider, so as a customer you must pay these expenses to receive your package.
In accordance with the international laws that regulate the trade of imports and exports of all orders, Gnomo sends its products from Valencia (Spain), with an official invoice declaring the exact total of the merchandise purchased in euros (€).
The purchases made in the Gnomo virtual store are subject to Spanish legislation. In the event of any conflict or discrepancy, the applicable jurisdiction will be that of the Courts or Tribunals of Valencia (Spain), as long as there is no legal provision that prohibits it.
SECTION 4 - RETURNS AND EXCHANGES. CHANGES.
If you have purchased a product in the Gnomo virtual store and later regret it, you can change it as long as you notify us within 7 days of receiving the order. In this case, the item must be in perfect condition, it must not have been opened or used and must retain its original packaging or seal.
The item may be exchanged for another of equal or higher value if you pay the difference in amount. You can send us the product you want to exchange or we can pick it up at the same address we sent it to. In any case, you will have to bear the shipping costs. We will send you the new item once we verify that the first one is in perfect condition.
Returns: defective products
We will only accept item returns if the product is defective or damaged. In that case, Gnomo will bear the cost of the change or repair, as long as you notify us of the incident within 7 days of receipt of the shipment. We will collect the defective product at the same address where we sent it to you and, once the possible defect and its causes have been verified, we will proceed to repair or replace it. Afterwards, Gnomo will resend the item to you in perfect condition as soon as possible and at no additional cost to you. Items purchased at gnomo.eu that have the manufacturer's warranty are excluded from this condition, in which case you must follow the procedure and conditions indicated by the manufacturer. If a different product than the one you bought arrives by mistake, we will pick it up and deliver the correct one without you having to worry about anything.
Gnomo expressly guarantees that the data you provide us is kept with absolute confidentiality.

Treatment of your personal data
In order to process your order, we will ask you to provide us with certain personal data such as name and surname, address, telephone number and email, which will be processed in a computerized way. You expressly authorize said data to be stored in our customer database for internal use. All visitor data is saved with an anonymous user ID and we DO NOT use it to advertise to you. You can breathe easy: our products will not chase you all over the Internet. We like that, if you come to see us, it is because you want to :)
If you choose to give us your email to receive our newsletter, you may receive information about Gnome in the future. We will send you (only from time to time) news about products, services or special offers through our mailing list. You can delete your address from the mailing list at any time, simply by sending us an email. Sometimes it takes 3-5 days to unsubscribe from the mailing list.
Credit card details
Gnomo never receives your credit card data, these are processed through a secure Shopify protocol, responsible for providing the respective remote electronic payment services, without any third party being able to access them in any case. Such data will never be used by Gnomo other than in order to complete the procedures related to the purchase, issue the corresponding refunds in case of eventual returns and to prevent the police forces in the event that any fraud is committed in Gnomo.
Gnomo takes all necessary measures to protect the confidentiality of your personal information.
Only authorized employees have access to the databases that store user information or to the servers that host our service.
